Terms of service

Last updated: 5 July 2026. These plain-English terms cover your use of MallStall. By creating an account or using the service, you agree to them. If you use MallStall on behalf of a business, you agree to these terms for that business.

1. What MallStall is (and is not)

MallStall is software. It gives market organisers, stall holders, food trucks and other event vendors a booking page, a calendar, and a way to take payments. We provide the tools only.

We are a platform, not a party to your bookings. Any market, stall, event, booking, or the goods and services provided are solely between the people involved (for example, an organiser and a vendor, or a vendor and their customer). MallStall is not the seller, organiser, employer, or provider of anything booked or sold through the service. We do not vet, endorse, verify, or guarantee any user, market, listing, or the safety, quality, legality, or accuracy of anything offered, sold, or provided.

2. Your account

You are responsible for your account, for keeping your login details secure, and for everything done under your account. You must be at least 18 and provide accurate information. Don't use someone else's account or let others use yours.

3. Your responsibilities and warranties

You are responsible for how you run your market, stall, service, or event. You confirm and warrant that:

  • You hold all licences, permits, registrations, and approvals required for your activities (for example, market or event permits, food handling registration, and any council approvals).
  • You hold appropriate insurance for your activities, including public liability insurance where it is required or reasonable.
  • You comply with all applicable laws and standards, including food safety and hygiene, health and safety, consumer, privacy, and tax laws.
  • The information you publish (prices, dates, descriptions, what you sell) is accurate and not misleading.
  • You are responsible for the safety, conduct, and outcome of your market, stall, service, or event, and for your dealings with the people who book you or whom you book.

4. Insurance and compliance

Insurance and legal compliance are your responsibility, not ours. MallStall does not provide insurance, and does not check, verify, or guarantee any licence, permit, or insurance that any user holds, references, or uploads. If MallStall offers a place to note or attach insurance details, that is for your convenience only and does not mean we have reviewed or approved it.

5. Bookings, payments, and refunds

When someone books through MallStall, the agreement for that booking is between the users involved, not with us. Where online payments are enabled, they are processed by Stripe and are subject to Stripe's terms. The organiser or host is the merchant of record, and Stripe's processing fees come out of their payout.

MallStall charges a platform fee on payments processed through the service (currently 5% on the Free plan and 1% on Pro), shown before you take payments and separate from Stripe's fees. We may change our fees with reasonable notice.

Refunds, cancellations, no-shows, and what happens at a market or event are the responsibility of the organiser or host, not MallStall. We provide tools to issue refunds, but we are not responsible for refund decisions, disputes, or chargebacks between users. Any dispute about a booking, payment, or the goods or services provided is between the people involved.

6. Acceptable use

Use MallStall lawfully. Don't use it to break the law, to defraud anyone, to sell prohibited or unsafe goods, to sell age-restricted products without the required authorisation, to harass people, to upload harmful content, or to attempt to disrupt or attack the service. We may suspend or remove accounts that break these terms.

7. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless MallStall and its operator from and against any claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or connected with: your use of the service; your market, stall, event, goods, or services; any injury, illness, loss, or damage suffered by any person in connection with your activities; your breach of these terms; or your breach of any law or third-party rights.

8. The service is provided "as is"

MallStall is offered without warranties of any kind. We work hard to keep it running and improving, but we don't guarantee it will always be available, secure, error-free, or fit for a particular purpose. The product is actively developing and features may change.

9. Limitation of liability

To the extent permitted by law, MallStall and its operator are not liable for indirect, incidental, or consequential losses, lost profits, or lost data, and our total liability to you for any claim is limited to the greater of the fees you paid us in the 12 months before the claim, or AUD 100. Nothing in these terms excludes or limits rights you have under applicable consumer law that cannot be excluded.

10. Ending your use

You can stop using MallStall and delete your account at any time from Settings or by emailing us. We may suspend or end accounts that breach these terms or that create risk for other users or for us.

11. Governing law

These terms are governed by the laws of New South Wales, Australia, and you submit to the courts of that state.
